Service Agreement & Terms of Service
These terms (the “Agreement”) govern the services provided by Rally Media. By checking the acceptance box and completing checkout for the Monthly Plan, the purchaser (the “Client”) agrees to this Agreement. The Agreement is effective as of the date of checkout.
1. Parties

2. Services Included
- Custom Website Build — design and build of a custom business website, delivered live and ready to use.
- Monthly Care — hosting, security, the site’s AI assistant, reasonable content updates, and a monthly performance report.
- Local SEO & AI-Search Optimization (AEO/GEO) — on-page and technical SEO, city and service pages, structured data, and optimization so the business can be found and recommended by Google and AI assistants.
- Google Business Profile Optimization — setup and/or optimization of the Client’s Google Business Profile, plus Bing Places and search-engine registration.
The website typically includes multiple pages built for the Client’s trade (home, services, service areas, reviews, FAQ, contact/quote). Target launch is within 7–10 business days of the Provider receiving the Client’s onboarding information.
3. Fees & Payment

- The first month’s payment reserves the build slot and starts design and development.
- Each month’s fee is paid in advance and is non-refundable once that month’s service has begun.
- The Monthly Plan covers design & build, hosting, security, the AI assistant, the monthly report, and reasonable content updates (text, images, hours, offers). New pages, full redesigns, or new features are quoted separately by written change order.
- Late or failed payment may pause services (including hosting) until the account is current.
4. Client Responsibilities
- Complete the onboarding form and provide business information, photos, and content promptly.
- Designate a point of contact and provide consolidated feedback within 5 business days of each draft.
- Ensure the Client has rights to all content, images, and branding supplied to the Provider.
5. Revisions & Timeline
The build includes two rounds of consolidated revisions before launch. The Provider will make reasonable efforts to meet target dates; timelines depend on the Client providing content, feedback, and payment on time, and Client-caused delays may shift the schedule.
6. Ownership & Cancellation
- The Client owns their business content (text about their business, their photos, their branding).
- The website, its design, and underlying code are hosted and licensed to the Client as part of the active Monthly Plan.
- Either party may cancel with written notice (email or text is fine). If the plan is cancelled, service and hosting continue through the end of the paid month, then end. On request within 10 days of cancellation, the Provider will export and deliver the Client’s content.
- The Provider may display completed work in its portfolio unless the Client asks otherwise in writing.
7. Warranties & Limitation of Liability
The Provider will perform the services in a professional manner. Except for that, the services are provided “as is.” The Provider does not guarantee specific business results, search rankings, traffic, or revenue. To the maximum extent allowed by law, the Provider’s total liability under this Agreement is limited to the amount the Client paid the Provider in the three (3) months before the claim. Neither party is liable for indirect or consequential damages.
8. General
- Independent contractor. The Provider is an independent contractor, not an employee or partner of the Client.
- Governing law. This Agreement is governed by the laws of the State of North Carolina.
- Entire agreement. This is the entire agreement between the parties and replaces prior discussions. Changes must be in writing and agreed by both parties.
- Assignment. Neither party may assign this Agreement without the other’s written consent, except the Provider may use qualified subcontractors.
Acceptance. Checking the “I agree” box and completing checkout constitutes the Client’s electronic acceptance of this Agreement, with the same force as a written signature. A copy of these terms is available anytime at gorallymedia.com/terms.
